Our Services are very diverse, so sometimes additional terms or product requirements (including age requirements) may apply. Additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer notice, and any or all Agreements: “Client”, “You” and “Your” refer to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We” and “Us” refer to our Company. “Party”, “Parties” or “Us” refers to both the Customer and ourselves, or either the Customer or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether through formal meetings of a fixed duration, or by any other means, with the express purpose of meeting the Client’s needs in terms of providing the Company’s declared services/products, in accordance with and subject to applicable US laws. Any use of the above terminology or other words in the singular, plural, capital letters and/or plural, and/or these terms, is considered interchangeable and therefore a reference to them.
Using our Services
You must follow any policies made available to you within the Services. Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services. Don’t remove, obscure, or alter any legal notices displayed in or along with our Services.
In connection with your use of the Services, we may send you service announcements, administrative messages, and other information. You may opt-out of some of those communications.
Some of our Services are available on mobile devices. Do not use such Services in a way that distracts you and prevents you from obeying traffic or safety laws.

Subscriptions
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring subscription and may receive certain discounts.
Software in our Services
When a Service requires or includes downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings.
Truckers Health Network gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by Truckers Health Network as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by Truckers Health Network .com, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions, or you have our written permission.
Disclaimer
Exclusions and Limitations
The information contained on this website is provided on an ” as is ” basis. To the fullest extent permitted by law, this company:

Liability for our Services
To the extent permitted by law, the total liability of Truckers Health Network .com, and its suppliers, vendor partners, and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services.
In all cases, Truckers Health Network, and its suppliers, vendor partners, and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.
However, this company does not exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. We recognize that in some countries, you might have legal rights as a consumer. None of your legal rights as a consumer are affected waived by contract.
Business uses of our Services
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Truckers Health Network and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, arbitration, litigation costs and attorneys’ fees.
Cancellation Policy
A minimum of 24 hours’ notice of cancellation is required. Such notice may be given, in person, by email, mobile phone, text message and/or fax, or by any other means, and will be accepted subject to written confirmation. We reserve the right to charge a cancellation fee of $25.00 to cover any administrative costs.
Modifying and Terminating our Services
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.
The Customer and Truckers Health Network have the right to terminate any Service Agreement for any reason whatsoever, including the termination of services already in progress. Truckers Health Network may also stop providing Services to you or add or create new limits to our Services at any time.
Refunds Policy
No refund will be offered when a service is deemed to have commenced and is, for all intents and purposes, in progress. Any amount paid to us that constitutes payment for the provision of unused Services, will be refunded.
Log Files
We use IP addresses to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Force Majeure

Waiver
Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

The courts in some countries will not apply Arizona law to some types of disputes. If you reside in one of those countries, then where Arizona law is excluded from applying, your country’s laws will apply to such disputes related to these terms.

Truckers Health Network strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.
Your personal information is never shared outside the company without your permission, except under conditions explained above. Inside the company, data is stored in password-controlled servers with limited access. Your information may be stored and processed in United States or any other country where Truckers Health Network, its subsidiaries, affiliates or agents are located.
You also have a significant role in protecting your information. No one can see or edit your personal information without knowing your user name and password, so do not share these with others.
NOTICE TO PARENTS
Parents or guardians: we want to help you guard your children’s privacy. We encourage you to talk to your children about safe and responsible use of their Personal Information while using the Internet.
The Truckers Health Network site does not publish content that is targeted to children. However, if you are concerned about your children providing Truckers Health Network any personal information without your consent, Truckers Health Network may offer a Kids account. It allows parents to give parental consent for the collection, use and sharing of children’s (ages 12 and under) personal information online.
ENFORCEMENT
If for some reason you believe Truckers Health Network has not adhered to these principles, please notify us by email at info@truckershealthnetwork.com, and we will do our best to determine and correct the problem promptly. Be certain the words Privacy Policy are in the Subject line.
ELECTRONIC PRODUCT REGISTRATION
When you buy and install a new product, we may ask you to register your purchase electronically. When you do, we merge your registration information with any information you’ve already left with us (we call that information your personal profile). If you haven’t previously registered with us, we create a personal profile for you from your product registration information. If you ever want to review or update that information, you can visit the Profile Center, click on Update Profile, and edit any of the Personal Information in your profile. If you haven’t already created a Registration ID, we will ask you to do so. This ensures that only you can access your information.
CUSTOMER PROFILES
As mentioned above, every registered customer has a unique personal profile. Each profile is assigned a unique personal identification number, which helps us ensure that only you can access your profile.
When you register, we create your profile, assign a personal identification number, then send this personal identification number back to your hard drive in the form of a cookie, which is a very small bit of code. This code is uniquely yours. It is your passport to seamless travel across info@truckershealthnetwork.com, allowing you to download free software, order free newsletters, and visit premium sites without having to fill out registration forms with information you’ve already provided. Even if you switch computers, you won’t have to re-register – just use your Registration ID to identify yourself.
What we do with the information you share
When you join us, you provide us with your contact information, including your email address. We use this information to send you updates about your order, questionnaires to measure your satisfaction with our service and announcements about new and exciting services that we offer. When you order from us, we ask for your credit card number and billing address. We use this information only to bill you for the product(s) you order at that time. For your convenience, we do save billing information in case you want to order from us again, but we don’t use this information again without your permission.
We occasionally hire other companies to provide limited services on our behalf, including packaging, mailing and delivering purchases, answering customer questions about products or services, sending postal mail and processing event registration. Membership Terms & Conditions
Opt-In Consent to Receive Communication
Thank you for signing up for a membership with Truckers Health Network (THN)! By agreeing to this disclosure and voluntarily supplying your contact information, you acknowledge and consent to receive communications from THN (and/or any person or entity acting on THN’s behalf or servicing your membership for THN).
These communications will be in connection with your membership and related to the reasons for which your contact information was provided and may include updates such as addressing technical problems associated with your membership or sending you notices and updates regarding, for example, benefits of membership or the status of an open ticket.
Communication may be sent to any and all contact information you have voluntarily provided including your telephone number, email address, or other such information included on your application for membership or which you may provide in the future. You further acknowledge and consent that THN may communicate with you through any current or future means of communication, including but not limited to: automated telephone dialing equipment, as defined by law, the FTC, or the FCC; artificial or prerecorded voice messages; telephone or other electronic facsimile machine; SMS or text messages; and email directed to you at a mobile telephone service, or email otherwise directed to you.
You acknowledge that such communications are informational communications related to your membership and are not made for any other purpose. THN (and/or any person or entity acting on THN’s behalf or servicing your membership for THN) may use such means of communication even if you will incur costs to receive such telephone messages, telephone calls, SMS or text messages, emails, or other means.
If you do not want to receive such communication (including SMS text messages) about your membership, you can unsubscribe through one of the following:
- Texting “STOP” upon receipt of a THN text message;
- Sending an email to info@truckershealthnetwork.com with the subject line
“STOP Membership Calls and Updates”; - Writing THN at the address of its current corporate headquarters which can be found at: truckershealthnetwork.com and which is presently 625 W. Southern Ave., Suite E, Mesa, AZ 85213 or –

Additional Terms and Conditions of Membership
Auto-Draft:
I authorize THN to regularly draft my bank account/credit card in the amount specified by the THN plan and in accordance with my THN membership agreement. A receipt for each such auto-draft will be provided to me and the charge will appear on my bank account/credit card statement as an “ACH Debit.”
I agree that no prior authorization will be provided unless the date or amount changes, in which case I will receive a one-time notice from THN at least thirty (30) days prior to the payment being collected. I understand that THN will deem me to have consented to such change unless I cancel my membership prior to such change taking effect.
I understand that this authorization will remain in effect until I cancel it in writing, and I agree to notify THN in writing of any changes in my account information or termination of this authorization at least fifteen (15) days prior to the next billing date.
If the above-noted payment dates fall on a weekend or holiday, I understand that the payments may be executed on the next business day. For ACH debits to my bank account, I understand that because these are electronic transactions, these funds may be withdrawn from my account as soon as the above-noted periodic transaction dates.
In the case of an ACH transaction being rejected for Insufficient or Non-Sufficient Funds, I understand that THN Pro-Driver may at its discretion attempt to process the charges again.
I acknowledge that the origination of ACH transactions to my account must comply with the provisions of U.S. law. I certify that I am an authorized user of this bank account and will not dispute these scheduled transactions with my bank, so long as the transactions correspond to the terms indicated in this authorization form.

I agree to keep THN informed of any changes to or updates in my contact information including, but not limited to, phone number, email address, and physical address. I understand and agree that it is my responsibility to notify THN of any such changes in my contact information so that THN can communicate with me regarding benefits of membership, including updates on open tickets, in an appropriate time frame.
